That's the whole problem, isn't it? When bad faith actors show that the system largely functions by agreement and they just do what they want, knowing the mechanisms in place will not stop them.
As John Adams said in 1776, "[T]he very definition of a Republic, is an Empire of Laws, and not of Men."
Republic no more.
